There is a difference, my friend. Porting to EB2 means you have to spend LOTS of $$$ and time and effort to get masters degree.
No matter how you look at it, it is not wise to hack away at any door that's open to all. We should look at expanding our vistas, not shrink it. What if I tell you I am thinking of starting up a co in India, so some day I can make it here using the EB1 route? Why do you want to prevent me from availing this opportunity and making my sacrifices -- just because you feel it will help YOU move forward by ONE INCH?
How about people are using it as a loop hole and smack you down. Just because you have the option, it does not mean the right thing.

I am sorry for posting in here, but I was wondering if someone actually went in person to the Houston Consulate to get their passport renewed. Also, do we need to have any reason to attend in person at the Consulate such as emergency, etc.

It is better to appear in person because of the two reasons:
1. Avoid any chances of losing/delaying the mail.
2. If any extra document is needed, you will come to know right away and you can ask your questions/doubts at the same time.
I went in person to the SFO Office and got my passport next day.

Reverse Brian Drain. I believe it is already been identified and some of the State governors wrote to Washington that they are observing a reverse brain drain and it is not good for the country.
I just started my GC Process, But I kept a 5 Year time frame to try this out. That is my breaking point. I am sure everybody will have some or other breaking point. I don't think I want to browse IV website lifetime.
We do need to fight and give a sincere try to achieve this before the whole thing breaks out. But if it breaks out, I am sure both ends lose. I lose an opportunity to enjoy American dream.
Of course, America loses, jobs that I am indirectly creating. Taxes that I am paying. Social security. More than everything my experience.
In all this, my home country gains. All my savings and experience will work for India. I think it is an opportunity loss for America.
Imagine, 1M people, with an average saving of 20K per year with atleast 10 Years of compounding and then sending all this money to Home country to go back and settle there. It will create enough financial turbulence for any country.
On the contrary, Imagine the other way, if they give say citizenship faster, All those Indian Savings, repatriate to America. All of a sudden, America will add lot of fortune to their GDP for free.

i just returned from an infopass meeting... the guy i talked to said that they recently have a directive from the DHS/USCIS that they want to separate the legal stuff from the illegal stuff and hence they are planning to adjudicate a record number of EB apps in the next quarter or two... does anyone else concur? is this true or were my ears just ringing in that meeting?

One thing that no one has pointed out and I wonder if people even care about it, but to me its a BIG issue.
All our hard earned $$$$ going into the Social Security and Medicare pool. Has anyone even thought about this ? If you look at your figure closely, it is the amount of money that an average american family saves over 1 year.
I personally feel that it is too big a contribution to let it to waste and for me getting a green card would make me eligible to get all the benefits that I deserve and have rightly earned.

Ok. Now lets say I have EAD cards for me (primary applicant) and my wife. I can now have my wife start a company and have a job position similar to where I work. Now after 180 days, can I work for my wife's company invoking AC21 with my EAD??:D
and so when an RFE comes from USCIS , can this be shown as the similar job offer?
Really speaking, The USCIS only wants a promise of employment when they are adjudicating form 485 saying that I will be given a job after I get my green card:). So can I literally work anywhere for any job using my EAD until green card gets fully approved as long as I have a promise of employment (by my wife's company)? :p
Ofcourse i am risking the chance of being out of status if my 485 gets denied. i just want to make sure it wont get denied because the "similar job" offer is from my relatives (wife's) company.
any thoughts??:confused:

Man, in frustration people do not even know what to say and what not! Be very careful of what you spin and what you say. From the looks of it, this stuff has every chance of spinning out of control and it may have already started the ball rolling.Think about it for a second!. Once it goes that way, trust me, we will all live to regret that.

Remember, those 25000 are one of us. Once,they too were in line for Labor certifications, I-140s, medical exams and all that crap. And some of them were in the so called "FBI Name check" black-hole for an extended period of time. We should be rejoicing in the fact that most of those backlogs got cleaned up. Instead we have people questioning the validity of those newly approved GCs.My dear friends, god willing, we will all have GCs one day and tell me, how would you feel if someone else comes screaming at you just because he did not get one too.
Putting a "security lapse" spin on this could be very dangerous and should be avoided at any cost. I hope one of those anti-immigrant lobbies do not pick it up and start running with that. I prey that they do not revoke those already approved GCs, because if they do, then those poor 25000 souls will go through much more agony than what we are going through now.
It's very tough to get the genie back in the bottle once it is out, so think before you start popping that cork.

That only 57 is required is not correct. The vote needs 60 to pass the motion. If no is totaling up only 37 but if yes is 59 still then it would not pass. Also if the senator is absent then it is considered a NO vote.
Did you check the link in the original post? It clearly says " Required For Majority: 3/5" meaning 3/5th of the votes is required to pass it. All vote counts in the senate are relative, never absolute. Simple passing of a vote requires 1/2 of the votes and cloture motion requires 3/5 of the votes.

I'm on H1 and my wife is on H4. We have both got our EADs and have visa stamps till Jun 2010.
Can my wife switch to the EAD status and start working even though I remain on H1 status till my visa expiry? Is this allowed?
If yes, then can she travel on AP while I'm still on H1 visa?
If we're both re-entering the US, can the IO ask why is the spouse on EAD/AP and not the primary applicant?

Its shocking!!! They've foolishly approved many 2006 cases and dont tell me it was unpredictable and now ppl with 2003 r still waiting....how logical is this? A bunch of A** H**** working there or what?
I understand your frustration. Since there is no spillover in the first quarter of new fiscal year, it was expected that PD would move back. How can you you expect 2006 PD for Oct when there is no spillover visa numbers.
Next year Jul-Sep 2009, PD should move to mid 2006 again.

Listened to the recording. I simply cannot believe what the host was babbling again and again about. He was repeatedly asking Jay “Why should the laws be changes which were set 50 years ago?” I will tell him why the laws are normally changed in general (not related to our case at all). They are changed because by definition law is supposed to be just; it is supposed to be equal. It is required to be non-discriminating. It is changed because people’s life is affected adversely if it remains constant. Laws of nature are the only set on laws that cannot change and that is true because they took billions and billions of years to perfect themselves. Laws of any country on this earth are not perfect. They are made by human beings, who tend to make lot of mistakes. Now, what is amendment? It is a set of new rules that are written to rectify any mistakes made in the existing laws. That itself is changing the law, my friend Raj. There is no county on this earth whose laws have remained the same for a very long period of time, and yet keeping all the people in that country happy. Laws get changed because of the new values added to the system. That is why, my friend Raj, slavery was abolished in 1863 by President Lincoln (BTW my most favorite President). This did not happen by magic. It happened only when the president issued an Emancipation Proclamation, which basically is a law and the jist of that is , "all persons held as slaves henceforward shall be free”. Now how did this happen? Because of the civil war and why did the civil war took place? Simply because people cannot take it anymore. You should know all this Mr. Raj Khanna, you were there to witness it with your own eyes when you were 147 years old (well at least that’s what you claim through your profile).

To my understanding....USICIS should out source some of there work (mostly setting up PDs) to India...
