I filed 485 last july and want to file EAD now. I had FP done last year. If I do efiling for EAD will I have to go to ASC for photos. I saw in other posts that they have linked Biometrics but what abt the photos ?

eFiling EAD will result in ASC appointment for code 2 biometics (Finger Printing of right Index finger + photo). You need to take the appointment letter and one form of photo id (passport or drivers id).

FP has nothing to do with the EAD or AP.
It is a security check as part of 485 processing where you are checked for a criminal background.

I have a pending I- 485 in EB2 and My spouse has a pending 485 in EB3 since 2007. We both are using EAD and on AOS. We got married recently, and my PD became current now.
What is the best way to make use of this situation and add my spouse to my pending 485?
Do we have to file another fresh I - 485 or is there a way to link his EB3 485 application with mine?
If I have to file a new 485, what are the documents needed apart from Marriage certificate, Since my spouse is already on EAD and working, Do I still have to send affidavit of support, my pay slips, w2, EVL etc.? Do we have to send medicals again? Kindly clarify my questions. Help is appreciated.

My friend filed I-140 and I-485 concurrently on 8/6/2007. His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
how do you guys handle this prolem ? Any suggestion is appreciated.

I have applied for H1b to F1 visa transfer with an i-20 from a university for the Spring of 2010.
Now, I received an admission from a better university for the same term (Spirng 2010) and I wish to join the Second University.
Could you please tell me the procedure to join second university.

Hi Gurus,
I am in my 9th year H1-B. I have my I-140 approved and I-485 pending since July 2007 through employer A (EB-3).
Employer B is willing to hire me on H1-B (transfer) using AC21 portability (and similarity of jobs). After the move, employer A will revoke my I-140 for sure.
Can I apply for an H1-B transfer with employer C after a year or two using AC21 portability? I do not want to use EAD. I want to use H1-B tansfer (3 year extensions)?
This is a major decision that I have to make.
Please reply at your earliest convenience.

A short time earlier, Mr. Reid convened a conference call with liberal bloggers, offering assurances that Democrats would revive debate over the Iraq war. And he pledged to revive it soon, ending the silence that followed the White House�s outmaneuvering of Democrats last month to win more money for the war without a timeline to end it.
�They�ve been driving this debate very well,� Mr. Reid said later, speaking of the bloggers who have been pushing for Congress to end the war. �I understand their disappointment. We raised the bar too high.�
It has been nearly three weeks since Democrats have held a formal Iraq debate or voted on an Iraq proposal in the House or Senate. Not since they assumed the majority in January has there been such a lull. During the three weeks, Congressional approval ratings have fallen, and Speaker Nancy Pelosi said she knew why.
�It�s the war, I believe so, it�s the war,� Ms. Pelosi said in a brief interview on Wednesday. �In terms of the issue that the American people want to have resolved, the war is three or four times higher than any other issue.�
Some Democrats argue that it is high time for the party to turn its attention to domestic issues � energy legislation, immigration overhaul and lobbying reform � to allay concerns that Democrats have not achieved enough significant accomplishments during the first six months of their majority. A Los Angeles Times/Bloomberg nationwide telephone poll released this week found that 27 percent of Americans approve of the way Congress is handling its job, while 65 percent disapprove. And 29 percent of the more than 1,100 poll respondents, all registered voters, said Democrats were working to change how government is run, compared to 63 percent who said Democrats are governing in a business-as-usual manner. The margin of error was plus or minus four percentage points.
Ms. Pelosi said it had been difficult to convince some Democrats that despite their majority, they are limited in how they can change the president�s Iraq policy.
�Some Democrats understand that we don�t have the signature and we can only do so much,� she said. �Others are just very unhappy. I include myself among them, being very unhappy that we have not been able to bring the war to an end.�
With September being highlighted as a critical review period for Iraq policy � Gen. David H. Petraeus, the top American commander, is to report to Congress on the progress of the current troop buildup � Democratic leaders had initially hoped to tackle their domestic priorities in late spring and early summer. Representative Rahm Emanuel of Illinois, the chairman of the Democratic conference, said Democrats could not be drawn into focusing solely on Iraq. �We have to do Iraq and change the priorities of Washington,� he said. �You can�t become a one-trick pony.�
The war has been the underlying theme of the new Democratic Congress, with barely a week going by without legislators embroiling themselves in committee hearings, a floor debate or symbolic resolutions for and against the war. Democrats have walked a careful line, trying to keep their criticism alive, but lowering expectations that they alone can influence war policy.
The month of June, though, has so far unfolded with barely a word being uttered about Iraq. And lawmakers said they were hearing about it.
Senator Amy Klobuchar, a Minnesota Democrat who was elected last fall, said constituents were seeking reassurance that Democratic efforts to challenge the administration have not fallen off. She said voters had little interest in being schooled in the intricate rules of the Senate, where 60 votes are required for debate to proceed on legislation.

Hello, I really appreciate a lot if anyone here could help me on this..
The company I have been working with an H1B for a years got recently restructured to a new firm and it filed a H1B transfer for me this Feb. The petition got an RFE and the firm made an Appeal, which is now pending. The job looks now rather unsecure and I am not sure if the company will continue sponsoring me for a new H1B if this transfer got denied in the worst case scenario..
So my questions are:
1. Can I file a COS to F-1 while my H1B transfer appeal is still pending?
2. If my H1B transfer appeal got rejected, or I got laid off while it's still pending, after that happened is it still possible and in time to file a COS to F1?
I am really worried about my current situation now, and thank you very much if you could kindly help on it!

I got my I-140 approval in premium processing. But unfortunately, USCIS printed the new labor filing date (2010) when the attorney requested my I-140 to capture the old priority date which is June2004. My law firm already contacted USCIS to issue a revised notice with the old priority date (June2004).
How long does USCIS take to issue a revised I-140? Any feedback is greatly appreciated. Anything that we can do to expedite the release of the new I-140 notice with correct priority date?
Please let me know when you get a chance

My congressman's office came back with this response for my query on why my wife's case is pending..not even pre-adjudicated, while I got approved on Sept 3rd from TSC.
according to TSC, your file and your wife�s were separated at time of adjudication and that is what has caused the delay. I�m trying to find out why.
Anything like this happened to anyone. Is there anything that can be done, to recombine the cases. My attorney is not very responsive since he was with my last employer. What are my options? I am worried her case is falling thru the cracks. Without any information on the principal applicant and derivative's case may never get adjudicated.....

I am a dependent on an I-485 application, with my father being the primary applicant. The application has been pending since 2001, so I decided to first threaten USCIS with a lawsuit, and then maybe file a writ of mandamus. My question is whether I have authority to do so as a dependent. Can I represent the whole family or at least myself? My father is leaving the country for some time and it will be hard for him to participate in the process.
