My address that they had on file was also an old one, from 2 years ago. I have since moved, and done the online AR15 thing and received my EAD at the new address, so I'm not sure why/how the system showed the old address.

I am guessing that your EAD was driven by the address which you provided while applying for it. CIS may not confirm what's on file, when there is already an address mentioned in application itself.

Since you don't know that EB-3 PD was Nov-2001 before it became unavailable it tells me that you are not EB-3 India.

Remember this is the October VB...so thisis waht is in store for teh next Fiscal year..Oct 08 to Sept 09....so be ready for another year of drudgery....
I'd wait for the official bulletin and their forecast for the next few months before becoming really upset. I have bad stomach as it is. No need to get upset unless absolutely necessary.

Isn't that what senate is proposing forthe illegal that those who are inthe country for more than 5 yrs get special treatment compared to those who came 2yrs ago, so why that can't be applicable for Legal Immigrants?:rolleyes:

IV does not need a change in leadership. We have a very effective leadership that is working hard behind the scenes to bring about a positive change to the community. If we have not been noticing major changes, it's due to the passive (chaltha hai chalne do) nature of our community, who don't even lift a finger to swat a fly, until and unless they receive a RFE/NOID/Rejection letter from the USCIS.
No change in leadership will bring about any change, unless the community changes it's mentality, raises above narcissism, and becomes actively involved in the movement. This requires a "person with the face", a person ready to expose himself as a leader of the movement to motivate others; subjecting himself/herself to death threats (and other threats) from anti-immigrant goons like ITGrunt and others. Our fearless Aman Kapoor has made that bold sacrifice for the ungrateful community which blames him for all our collective failures.
So before proposing a change in leadership, I request Mr. Bawa to post his personal picture in the IV profile and/or publish a YouTube video of his ideas for the movement ( just like Aman's video on Immigration Voice). I can't vote for a faceless leader hiding behind anonymity. I need a real life person with real ideas. Do we have such New fearless leaders in our community?
I can post my picture or I may have a video on youtube. I am not trying to blame Aman. I am pointing at the wrong stratergy and a sleeping core team. They were good in 07 but not anymore. Let's find the new leaders. U can take names or call me whatever but I want something done above and beyond the idealism.

The senator is missing it or dodging it - it clearly means one thing -we are invisible as constituents. We are being taken for a ride only because we do not speak up or go meet our lawmakers. They do not see us as ordinary constituents having the same issues as their other constituents. The whole human -angle is missing.
We have to go meet our lawmakers and explain to them our part of the story/ They need to be told and made aware that we live in their constituencies and our grievances are genuine and need to be addressed.
And although this particular bill does not affect people that are here already.. Beware!! the noose is tightening- the next on the chopping block is EB Immigrants.

Recapture is actually a non controvertial issue and most politicians support it in private. The business lobby was sucessful in getting it done (btw the democrats opposed it even then). These days we have the sword of 'amnesty' hanging over everything related to immigration plus the positions are so polarized that it is impossible to get anything done. The lame duck presidency isnt helping either, each congressman/senator has to worry about its own agenda and their people.
With the internet every little bit of information is distributed immediately and the opposing forces can easly create noise to drown it...that in a nutshell is why nothing is working for us.
As mpadapa mentions people satisfied with EAD/AP think that life is good and dont want to help. When people wait in EB3 for 7-8 years and renew EAD/AP for 4-5 times like i have, they will understand. Untill then we hope and pray and call

Can someone explain what "Temporary Restrain Order" would do if it were successful. It sounds to me that the lawsuit is asking the court to temporarily invalidate the July visa bulletin so that USCIS will be forced to accept the applications. Is this a reasonable understanding? Any lawyers here?

H1b and GC are sponsered by employer and they have to pay. If employer asks employee to pay the expenses then that company is not legitimate and persons should avoid joining those companies. Most reputed companies will pay all the expenses of GC and H1b. Some will ask employees to pay for dependents EAD,AP etc.
Consulting companies ask employees to pay GC and H1b if employees want to work hourly. That means employees wanted more money and they are taking risk(Also working hourly is against the H1b regulations as they have more chance for falling out of status).
I tend to disagree with that. You are partly right that H1B cost should be borne by the employer. There are DOL regulations for that you can easily find on the web.
For GC, you are partly right in the sense that only the first stage - Labor Certification should be completely borne by the employer. DOL released the regulation last year w.e.f. July 16 2007. gimmeliberty, srinivas_o, x1050us, PKV4voice thank you so much. I was out for about a couple of hours and when I came back I saw all these contributions lined up. I cannot express the feeling I got. I was totally overwhelmed. After yesterday’s round, which took about 24 hours to close (estimation, I didn’t check), I was worried if we will be able to finish this round. But I am certain now that we will finish this round successfully. Of course, we will, if we have motivated people like you.
