Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

Hi Forum,
My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.
It would be great if you guys let me know what is the process of converting this without going back to home country.
I appreciate your help

I believe working on 1099 is allowed when you have the full time work on H1B going.
There are different types of 1099. 1099-Misc is not allowed. 1099-Int , 1099-G are the examples of allowed 1099s

I just had a consultation this week with an engineer working on an H-1B for several years with one of America's best known companies. I would appreciate some feedback on following situation;
1) My wife is on H4/EAD. She is beneficiary of my AOS application. She holds Master's Degree from US. What is the best option for her to work on?
2) She was on H1B from Oct 2001 to Mar 2003. She COS to H4 after her job terminated with-in weeks. Since then she's been in US (on H4) and never been out for more than couple of months. Can she apply for H1B and not limited to H1B quota and wait till Oct?
3) Would changing to H1B abondon her AOS?
4) Can she work on EAD now and switch to H1B around Oct time if she has to apply for fresh H1B for next yr quota.
4) If she can get H1B, can she still use AP for travel?
6) If i loose job or my 485 is denied, isn't it better she has H1B so i can get on H4 or on her GC application.

I work for one of big 4 consulting companies. Home office based NJ and live in NJ as well. Travel to Client A mon - thurs.
I rolled off from the project at client A and will be starting at client B.
Both Client A & B are in the same city in MA.
1. Will a LCA update be required even if you new client is in the same city/ state ?
2. How long does it take these days to update the LCA ?
3. Like H1 transfer can you start working at the new client on the USCIS receipt # ?

I have an approved I-140 in the EB 2 category and I'm changing my employer next month. However, my current lawyer emailed me this morning saying that you can transfer your PD, but not in the same category (EB2). In other words, to keep my PD, I will have to apply through EB1 or EB3 with my new employer. I had not heard of this before and was wondering if this is a true statement. Has anyone successfully transfered their PD within the same category? Thanks.

Is it true that if you are on H4 visa and you are using Ead ...and your I-485 is denied...this invalidates your H4 status and you have to leave U.S?
I know that this situation applies only for H1B holder, not H4, the dependent.
If I'm out of H4 status...what are my options? How can I go back to H4 status?
Please advice....this is vey important for me.

My wife is joining me on a H4. I plan to get her visa converted to H1 and my company is ready to sponsor her visa for conversion. Pls let me know if H4 to H1 visa is a tough thing. And also is there is last date we have to file the papers for this?? is it treated as a regular h1 quota or it lies outside of the quota and can it abe applied anytime??
She has a 16 yrs degree and has work exp which qualifies her for visa.

Maybe the 60 Minutes story from a few months ago is making a difference. DHS finally agreed today to show some humanity and not proceed for two year with deporting widows and widowers of US citizens (often American soldiers who die in combat) who only were denied green cards because their spouses died before USCIS could finish processing their cases. The courts have not been consistent in their rulings and it is going to take the US Supreme Court settling the matter (or DHS backing down). Hopefully, this marks the end of USCIS' rabid pursuit of a population that deserves...
