Hello Everyone,
My wife is trying to process visitor Visa for her parents and she has a problem with her mothers name in the Passport as it reads just the short name instead of her Full name.
I'm wondering if the Affidavit would be sufficient while going for Visa or would this still be a problem?
If affidavit is sufficient, can someone please kindly share the sample affidavit if you have one?

Good news for EB2-I people with 1999 and earlier PD's. They have been waiting far too long. Good luck for them. They have now done 10 years in the US, and will qualify for SS, anyway.

They don't verify anything. They ask you to fill in a form I don't remember the form number. I remember they were asking your full name, SSN, Address in US, Country of citizenship, place of birth, your father's and mother's first name.

Hello,
If one gets stuck with H1b revalidation, and then gets approved after 6 months. Is there any issues when coming back to the US at the POE entry?

I am in 6th year of my H1B. It is expiring in Aug 2011.
Here are some details:
- My I-140 is approved with a priority date of Aug 2006 under EB2-India.
- I did not apply for I-485 so I do not have a EAD.
- My wife is also on H1B which expires in Aug 2012.
Here are my questions:
1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.

I work for one of big 4 consulting companies. Home office based NJ and live in NJ as well. Travel to Client A mon - thurs.
I rolled off from the project at client A and will be starting at client B.
Both Client A & B are in the same city in MA.

The July bulletin shows the date as 15th Aug 2003. It's difficult to estimate when it'll get to July 2007 because the movement is not linear.

Any advantage of opening an account on USCIS website to receive automatic case status updates? or I don't need to do that if I keep checking the status online by myself?
They send you and email if something changes, nice if you have a Blackberry/pda
If you have multiple cases i-129, i-131, i-140, i-485 you can see them all on one page, I find that easier to see LUDs in particular the "soft" non-action ones, but it's nice to know the file was touched.

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

Company A has filed my 485/EAD/AP. I am planning to change company B on AC21 after 180 days. Can I use AP which is filed by company A, for travel purpose after switching to Company B?

Hi All,
My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".
Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?
Please advise.
