H1-H4-H1 conversion --Please advice
Posted Today at 10:14 PM by shreya
Hi,
I came US through H4.Currently on H1 since Oct 08. As Economy is bad,my employer couldnot place me in a project. So my employer is asking to convert from H1 to H4(by applying i-539) and once i get project can move back from H4 to H1, which will not come under seperate Quota as my H1 is already approved once.
Can i know is this safe to move from H1 to H4 and then back from H4 to H1 once i get project. Will there be any issues in converting H4 to H1.What are the chances of getting H1 back.
Please advice.Any suggestions is really appreciated.
Thanks

Hi,
I had an approved I-140 from my previous company with a priority date of Nov 2005. I moved to a new company, and my GC was applied again in Dec 2006. My previous I-140 was used to retain my priority date. However, my new I-140 from this company shows the priority date of Dec 2006.
How do I make sure that my previous priority date (Nov 2005) is on file, and my case will be filed according to that.
Thanks,
Prabhat

Hello,
Just wanted to ask if someone knows if I can become a student while in the US under a J1 status and do I have to go back to get a new visa for that?
Thanks in advance.

Read this else where, about I -140s being reopened and labor certification are being questioned. Is this true?
Yes, it is true that USCIS have reopened few cases wherever they have been suspecting of violations and frauds.

Hi,
I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!
If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.

Hello all, my apologies if you find my question naiive. We got our fingerprinting appt. notice in the mail yesterday with an EAC application no. When I look that number online it says case has been transferred to Texas and notice of transfer sent. Fine. I am not anxious or anything just wondering if a receipt will be generated now at Texas or would one have been generated at Nebraska and sent to the lawyer? The reason I as is I have been holding back travel plans and wanted to start looking at flights etc. if I know the receipt is either on its way or at the lawyer's already.
Thanks!
BTW the application was sent to Nebraska on July 30 and I140 had already been approved from Nebraska earlier this year.

The Concord (NH) Monitor reports on a very anti-immigrant resolution being considered in the New Hampshire House of Representatives that was instead modified to be one that promoted solving immigration problems: The original resolution, sponsored by state Rep. Jordan Ulery, a Hudson Republican, stated: "Amnesty rewards illegal aliens for breaking our laws," and continued, "Amnesty would allow illegal-alien gang members, criminals, and terrorists to be eligible to become citizens of the United States." The new resolution notes, "it would be impractical, if not impossible to expel the estimated 12 million people who have entered this country illegally." It concludes with...

Dear All,
Based on the lessons and experience gained from last Saturday demonstration in San Jose, we are organizing another protest this Saturday. A newly established yahoo group is working actively on preparing for this week's event.
We have been impressed with the participation from IV members. Please join the Yahoo group if you are in or near the San Jose area. Every bit of support and help is immensely valuable!

I already have my 485 pending at NSC. My state comes under TSC jurisdiction.
Where should i file for my EAD, if I don't file concurrently with 485? at NSC where my 485 pending or at TSC?
What are the documents I need to file for EAD?
Thanks for your time.

AILA Leadership Has Just Posted the Following:
Take 15 minutes today and watch this very moving Frontline documentary about the devastating effect of the Postville, Iowa ICE raid on the town and on the two villages in Guatemala where the immigrants came from. http://bit.ly/GWBVu[/URL]
The Postville operation was the largest ICE raid in U.S. history and resulted in the arrest, detention, and convictions of nearly 400 undocumented workers, most of whom were poor, uneducated Guatemalan farmers.
It makes me wonder what Iowa leaders are doing to help the people of Postville, who now live in economic ruin; especially Senator Tom Harkin, who has never condemed the unjust Postville prosecutions nor visited the town since the raid, yet recommended Stephanie Rose, one of the lead Postville prosecutors, to be U.S. Attorney for the Northern District of Iowa.https://blogger.googleusercontent.com/tracker/186823568153827945-87808768427206364?l=ailaleadership.blogspot.com

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.
